The company SUPERTICKET operates a platform (hereinafter the "Platform") accessible from the site www.best-events.com through which it offers its customers (hereinafter the "Buyers") various research services and the purchase of tickets (hereinafter "the Tickets") for cultural or sporting events in Europe (hereinafter "the Services").
SUPERTICKET and the Buyer are hereinafter referred to together or individually as a "Party".
These terms and conditions (hereinafter the "Terms and Conditions") are intended to set the terms and conditions for the provision of the Services provided by SUPERTICKET to the Purchasers, as well as to define the rights and obligations of the Parties in this context.
They express the entire agreement of the Parties and cancel and replace any agreement, letter, offer or other written or oral document having the same purpose.

2. Operator of the Platform

3. Acceptance of the General Conditions
The Purchaser declares by subscribing to the Services under the conditions set out below in the article "Access to the Platform and the Services", to have read these General Conditions and to accept them expressly.
This acceptance can only be full and complete, without any modification whatsoever. Any membership subject to reservation is considered null and void. Buyer who does not agree to be bound by these Terms and Conditions shall not use the Services or access the Platform.
4. Access to the Platform and Services
The Platform and / or the Services are accessible:
- Any natural person with full legal capacity to commit to these General Terms and Conditions and at least 18 years of age. Purchaser who does not have full legal capacity can only access the Platform and Services with the consent of his legal representative.
- To any legal person acting through a natural person with powers to contract on behalf of and for the account of the legal person.
5. Registration on the Platform
All Purchasers are required to open a User Account with Best Events on the Platform in accordance with the procedure described below to receive the Services (hereinafter the "Account"). The Buyer is obliged to:

The Buyer acknowledges and agrees that the information entered for the purpose of creating or updating his Account is proof of his identity and his professional capacity. The entered information commits it as soon as it is validated.
The Buyer acknowledges being informed that any incomplete registration will not be validated.
The registration on the Platform automatically entails the allocation of a personal space in a form and according to the technical means Best Events deems most appropriate to make the Services, consisting in particular of a web page allowing the User to use and manage the Services (hereinafter "the Personal Space").
The Purchaser accesses the Services by logging into his Account with his username and the password chosen during registration, which he acknowledges and accepts.
6.Us strictly personal
Only one Account may be created by Buyer. The person whose personal information corresponds to that provided on the registration form, to the exclusion of any other third party, is deemed to be the User Purchaser of the Services requiring prior registration, provided that in the event that the Account is opened by a legal entity, said Account will be validly operated by any duly authorized person.
The Buyer therefore agrees to use the Services personally, and not to allow any third party to use them in his place or on his own behalf, including to another Buyer user of the Services, except to support the entire responsibility.
The Buyer is also responsible for maintaining the confidentiality of his username and password and expressly acknowledges that any use of the Services from his Account will be deemed to have been made by himself. When the Account is opened by a legal entity, the latter recognizes that its Account may be operated by one or more authorized persons, from its login credentials. In this case, the legal person undertakes to make them respect the strictest confidentiality of their connection data.
In the event that the Buyer finds that his Account is or has been used without his knowledge, he agrees to notify Best Events as soon as possible, to the address indicated in the article "Platform Operator" ".
The Buyer agrees to create only one Account, Best Events reserves the possibility if necessary to delete any additional account created by the same Buyer. The Buyer also acknowledges that in the event that Best Events decides to suspend or close its Account, the Buyer may no longer create a new Account on the Platform, without limitation of duration. Best Events reserves the right to delete any new Account created by a Buyer whose previous Account was deleted by decision of Best Events.
7. Description of the Services
7.1 Provision of an event library
Best Events provides Buyers, on the platform, a database (hereinafter the "Library") created and organized by Best Events to perform the different services offered by the platform and containing all the music, cultural events or sportsmen (hereinafter the "Events")
The Events are classified by type of Events (musical, cultural, sports) and by genre, in a manner freely determined by Best Events.
Best Events provides each Buyer with access to the Event Library, accessible directly through the Platform's homepage. The search for Events is done by artist names and / or Events.
Buyer accessed via the Library web pages with every Holiday, which are published on a presentation of the Services offered by the Platform for the Event and any information deemed useful by Best Events, on terms and conditions to free choice Best Events and on which the Buyer can order the Services of the Platform (hereinafter "the Order")
The photographs, representations and descriptions of the Events are given as accurately as possible. However, they are only informative and indicative and do not engage the responsibility of Best Events, which the Buyer acknowledges and accepts.
7.2 Ticket pre-booking service
The Buyer has the possibility to pre-book Tickets for Events identified by Best Events before the official opening of the ticket office.
The Buyer acknowledges that he is aware that the Pre-Booking Service only covers certain events with very high affluence, specifically identified by Best Events at his free choice.
The Buyer accesses the Service by clicking on the "add to cart" button available on the Event page.
As part of the pre-booking of Tickets, the Buyer expressly mandates Best Events:
7.3 Ticket Purchase Service
The Buyer has the option to purchase tickets for events offered by Best Events on the platform in the stocks, and the price displayed on the page of the Event, by clicking the button "Add to Cart" what the Buyer recognizes and accepts.
At the time of the Order, the Buyer must provide information including:

7.4 Technical assistance
Best Events offers the Buyer technical assistance accessible by email at the coordinates indicated in the article "Operator of the Platform", from Monday to Friday, from 10am to 17h, allowing him to report any difficulty encountered when using the Services.
8. Terms of the Order
The Buyer places an order online on the Platform directly via the page of the corresponding Event.
The Buyer agrees to provide all required information as required, including the number of Tickets, the desired category and contact information for delivery and billing.
The Buyer expressly acknowledges that it is informed that Best Events reserves the right, subject to criteria that it freely determines, to limit the purchase of tickets for an Event with a maximum of four (4) tickets per person.
The Buyer can access the summary of his Order at any time as long as the Order is not definitively validated and can correct any entry errors.
The Buyer acknowledges being informed that an Order that does not contain all the information required as mandatory will not be validated.
Once the Order has been validated, the Buyer has direct access to a page summarizing the details of the Order. The Buyer is invited to check the completeness of the information provided, including the information required for delivery, before clicking on the "Buy" button.
The Buyer guarantees Best Events that all the information provided during the Order is accurate, up-to-date and truthful and is not vitiated by any misleading nature.
The Order is considered as definitively validated by Best Events after payment via the Platform.
Best Events immediately sends the Buyer an email confirming the Order, to the address provided during the Order.
9. Terms of Service Delivery by Best Events
> 9.1 Placement
For all the Services offered by the Platform, Best Events makes its best efforts to ensure that the tickets purchased correspond to seats side by side, unless expressly stated otherwise at the time of the Order.
In the event that a side-by-side placement is not possible for any reason, the Buyer acknowledges and accepts that Best Events reserves the right to allocate separate places or groups of squares side by side, at his own convenience, depending on the remaining available places.
In these conditions, Best Events undertakes to inform the Buyer who will have the opportunity to cancel the Order, by sending an email to Best Events, at the latest within forty-eight (48) hours from the notification.
Failing response within this time, the Buyer will be deemed to maintain his Order, which he recognizes and accepts.
In case of cancellation, the Buyer will receive an email confirmation of the taking into account of the cancellation of the Order and will be refunded in full within (30) thirty working days.
> 9.2 Format of the Ticket (s)
Best Events may provide the Purchaser with Paper Tickets, such as tickets delivered by post, or e-tickets, which shall be understood as electronically transmitted tickets.
The Buyer acknowledges and agrees that the choice of ticket format is beyond the control of Best Events.
The Buyer also acknowledges and accepts that Best Events, at its free choice, may transmit to it simple countermarks under the Order, which must be exchanged for the final title in conditions that will be specified on the countermark.
> 9.3 Delivery and Time
By default, Best Events provides delivery electronically when it comes to electronic e-Tickets, or by mail when it comes to Paper Tickets.
Regarding the Ticket Purchase Service, Best Events undertakes to make best efforts to ship the Tickets within 15 days of the validation of the Order.
Regarding the Ticket Pre-Booking Service, Best Events undertakes to make best efforts to ship the Tickets at the latest within 10 days before the Event.
However, the Buyer acknowledges that these deadlines are only indicative and may be modified by Best Events, at its convenience, in the event of a period of high demand or for certain Events. Best Events undertakes nevertheless to inform the Buyer in case of delay in the dispatch of the Tickets.
> 9.4 Category
Regarding the Ticket Purchase Service, Best Events undertakes to provide the Buyer with Tickets in the category indicated at the time of the Order.
Regarding pre-booking services,
· Best Events reserves the right, at its free choice, either to acquire Tickets in a higher category, at no additional cost to the Buyer, or to cancel the Order under the conditions set out below, if it does not arrive to obtain Tickets only in a lower category,
· Best Events agrees to notify the Buyer if it is able to acquire the Tickets in a category less than that requested at the time of the Order and obtain its agreement before any acquisition of the ticket. In case of refusal, Best Events will proceed to the cancellation of the Order according to the conditions provided below.
10. Cancellation of the Order by the purchaser / right of withdrawal
The Buyer is expressly informed and agrees that the Services are provided as soon as the Order is validated and that their execution takes place before the end of the 14 day legal withdrawal period.
Therefore, the Buyer expressly waives his right of withdrawal, which can not be exercised, in accordance with Article L.121-21-8 of the Consumer Code and recognizes that he can not ask for cancellation except as expressly provided below.
The Buyer may nevertheless inform Best Events of a change of delivery address by sending an email to the address indicated in article 2. The request to change the delivery address will only be taken into account if the Order has not already been shipped, which the Buyer acknowledges and accepts.
However, the Buyer may request the cancellation of the Order in the following cases:
· In case of pre-booking service, the Buyer has the possibility to cancel his Order by email, for any reason whatsoever, up to 72 hours before the official opening of the ticket office.
Under these conditions, a refund of 95% of the initial amount of the order is made. The reimbursement of the order occurs within (07) days, by any means deemed useful to the free choice of Best Events.
> 11. Cancellation of the order by Best Events
In the context of the execution of the Pre-Reservation Service and in the event that Best Events is unable to acquire the Tickets subject to an Order, the Price of Services will be fully refunded to the Buyer, in a period of thirty (30) days, by any means considered useful to the free choice of Best Events.
In any case, as part of the Pre-booking and Ticket Search Services, if Best Events is unable to obtain Tickets in the desired category and the Buyer refuses to change the category, the Order will be canceled and the Price of Services will be refunded in full to the Buyer, within thirty (30) days, by any means considered useful to the free choice of Best Events.
In the case of a sale where the Best Events website has stock, if Best Events is unable to obtain Tickets in the desired category and the Buyer refuses to change the category and date, the order will be fully refunded within (30) thirty business days.
12. Cancellation or postponement of the Event
The Purchaser acknowledges and accepts that the responsibility of Best Events may in no circumstances be held liable for any reason whatsoever, in case of cancellation, modification or postponement of the Event after the validation of the Order.
Best Events agrees to inform the Buyer of any cancellation, modification or report brought to its attention, as soon as possible, by any means deemed useful and in particular by email to the address provided by the Buyer at the time of the Order .
In case of cancellation of an Event by its producer, Best Events agrees to refund the face value of the Tickets provided that the Buyer returns the Tickets corresponding to the Order to Best Events, by registered mail with acknowledgment of receipt only when the Tickets provided are Paper Tickets. However, the Buyer acknowledges and accepts that Best Events keeps the Commission as defined in Article 13 hereof:
Best Events shall acknowledge receipt of the said letter at the latest within fifteen (15) days of the notification of the cancellation, the date of the first presentation of the aforementioned letter between the Parties.
The refund will be made within thirty (30) days, by any means considered useful to the free choice of Best Events.
The Buyer acknowledges and accepts that the costs incurred by him in returning the Tickets to Best Events will be borne by him.
In the event of postponement of the Event or modification of the venue and / or the time of the Event, Best Events reserves the right, at its discretion, to send a modified Ticket to the Purchaser or to proceed the reimbursement of the face value of the Notes, which the Buyer acknowledges and accepts.
As part of a refund, Best Events undertakes to proceed with the refund provided that the Buyer returns the Tickets in accordance with the same terms and conditions as in the context of a cancellation of the Event by its producer.
13. Billing and payment of the price
13.1 Price of Services
The price of the Services (hereinafter "the Price of the Services") is indicated on the page of the Event and includes:
· The face value of the Ticket,
· The cost of the Best Events Services including any taxes, the costs of research, acquisition and processing of the Buyer's Order, (hereinafter the "Commission").
The price is expressed in euros, all taxes included.
Best Events reserves the right, at its discretion and according to terms and conditions of which it will be the sole judge, to propose promotional offers or price reductions.
The Buyer acknowledges and agrees that the price of the Services for the same Event may vary in time up or down depending on the evolution of the request, at any time, at the discretion of Best Events.
The new rates will be immediately applicable to any new Order, which the Buyer acknowledges and accepts.
13.2 Terms of payment
The price is payable immediately online on the Platform, by credit card, through the payment provider of its choice (hereinafter the "Payment Provider"), which the Buyer acknowledges and accepts.
The Buyer acknowledges being informed and agrees that he must pay the Cash Service Price.
The Buyer further guarantees Best Events that it has the necessary authorizations for payment.
The Buyer acknowledges that he / she is informed that the details and bank information provided at the time of payment of each Order will be collected by the Payment Provider chosen by Best Events and indicated on the Platform and will be kept by him in a secure manner during the legal period of retention. said data. Best Events does not keep any banking data.
14. Duration - Unsubscription
These General Terms and Conditions apply during the entire period of execution of the Services once the Purchaser has placed an Order.
The Purchaser may close his Account at any time by sending an email to Best Events at the address given in Article 2.
The closure of the Account is immediate, subject to any Orders in progress. In this case, the Account will be closed after the delivery of the last Order recorded by Best Events.
The Buyer is expressly informed and agrees that all information and documents stored in his Personal Space will be deleted immediately after the closure of the Account. The Buyer will do his best to recover the data on the media and in the format of his choice, which he recognizes and accepts.
> 15. Service Level Guarantee
Best Events will make its best efforts to keep the Platform running 24 hours a day, 7 days a week, except in case of force majeure.
If necessary, Best Events reserves the right to limit or suspend access to the Platform, to perform any maintenance and / or improvement. In this case, Best Events agrees to inform in advance by general informative message on the homepage of the Platform of these maintenance and / or improvement operations.
Best Events undertakes to implement all the technical means, in accordance with the practices of the profession and with the state of the art, necessary to ensure the security and the access to the Services, concerning the protection and the monitoring infrastructure, controlling physical and / or intangible access to these infrastructures, as well as implementing detection, prevention and recovery measures to protect servers from malicious acts.
Best Events also undertakes to take all necessary precautions, in view of the nature of the data and the risks presented by the automated data processing implemented for the needs of the Services, to preserve the security of the data, and in particular to prevent that they are distorted, damaged or unauthorized third parties have access
Any complaint relating to the nonconformity of the Order must be formulated by email, at the address indicated in article 2, within seven (7) working days from receipt of the Order and before the Event. No later complaint will be admissible.
Best Events may, at its option, offer any form of compensation deemed useful, provided that Best Events recognizes the merits of the claim. Best Events will contact the Buyer directly within a maximum of seven (7) days from receipt of the complaint to indicate that it does not intend to respond to the claim that appears to be unfounded in view of its obligations hereunder, the proposed method of compensation.
Any claim relating to the non-receipt of the Order must be made by email to the address indicated in Article 2 at least (i) 15 days before the Event for the Ticket Purchasing Service, 7 days before Event for the Pre-booking Service.
Failing this, no later claim will be admissible.
> 17. Exclusion of liability and warranty of Best Events
Best Events undertakes to provide the Services diligently and according to the rules of the art, it being specified that it weighs on it an obligation of means, to the exclusion of any obligation of result, which the Buyer recognizes and expressly accepts. Its liability is exclusively limited to the provision of the Services as described herein, to the exclusion of any other services.
Best Events declines any responsibility in case of possible loss of the information accessible on the Buyer's Account, the Buyer having to make sure to save a copy of the information he deems necessary and can not claim any compensation in this respect.
Best Events undertakes to carry out regular checks to verify the functioning and accessibility of the Platform. As such, Best Events reserves the right to temporarily suspend access to the Platform for maintenance reasons. Likewise, Best Events can not be held responsible for temporary difficulties or impossibilities of access to the Platform caused by external circumstances, force majeure, or due to disruption of telecommunications networks.
In any case, the liability liable to be incurred by Best Events under these General Conditions is expressly limited to proven direct damage suffered by the Buyer. Best Events shall not be liable to the Buyer for the payment of damages of any kind whatsoever, direct, material, commercial, financial or moral, as a result of the Purchaser's use of the Services for an amount of greater than the amounts invoiced by Best Events as compensation for the Services that led to its liability, at the time of the occurrence of the alleged damage. The responsibility of Best Events can only be engaged if the Buyer has made a claim under the conditions provided for in the article "Complaint".
The Buyer acknowledges that the exclusion of liability provided for in this article applies only to any professional Buyer who is not a consumer within the meaning of the law.
> 18. Publicity
Best Events reserves the right to insert on any page of the Platform and in any communication to the Buyer all advertising or promotional messages in a form and under conditions Best Events will be the sole judge
19. Modification of the General Conditions
Best Events reserves the right to modify these Terms and Conditions at any time.
Best Events reserves the right to modify and / or stop offering all or part of the Services, at any time at its discretion, subject to the proper fulfillment of Orders already registered on the date of modification of the Services.
The modified Terms and Conditions will apply to any Order placed after their entry into force.
If he does not accept the amended General Conditions, he must no longer use the Services and request the deletion of his Account, if applicable.
Any Purchaser who makes use of the Services subsequent to the entry into force of the modified General Conditions is deemed to have accepted these modifications which will be fully applicable to him.
